From the Middletown Police Department
On September 7, 2011 the Middletown Police Street Crime Unit along with The Patrol Division responded to The Madison Apartments at Chestnut Hill, Town Colony Drive Building 12 Apartment 328. Building Maintenance had received a complaint of a leak coming out of apartment #328 into the apartment directly below. Upon inspecting the apartment, Building Maintenance, discovered a marijuana grow inside of the south east bedroom in apartment #328. Maintenance personnel also observed several gun cases in the “grow room”. A resident of the apartment Elizabeth Clark age 24 arrived home. Clark had no explanation for the maintenance personnel.
Clark then removed several firearms that were stored in the “Grow Room” along with a small bag of marijuana from the apartment. Clark hid the guns in the wood line at the rear of the apartment building. Maintenance personnel observed Clark as she then walked around the exterior of the building to the front parking lot. As detectives arrived maintenance personnel advised them that they had just observed Clark come from the rear of the building and that the gun cases they had observed in the grow room were now missing. As Detectives went to the rear of the building they discovered two dry gun cases containing two assault rifles (Colt AR-15, AK-47). They also observed a dry shopping bag containing three handguns (Smith & Wesson .44 cal, Taurus .45 cal, and a Walther .22 cal.), a small amount of marijuana, and a glass smoking pipe.
Clark was taken into custody and stated she had contacted her two roommates and advised them to come home.
Detectives then attained a Search and Seizure Warrant for apartment #328.
Inside of the southeast bedroom was an elaborate “grow room” with several mature marijuana plants along with reflector walls, light ballasts, humidifiers, ventilation system with exhaust fans, irrigation system, temperature gauges, timers, bottles of liquid plant foods and minerals, and smoking pipes.
Also located in the apartment were two other handguns (Ruger LCR .38 cal, Taurus 9 mm), a large amount of ammunition, and numerous magazines including two 100 round drums for the assault rifles. There was a large amount of narcotic packaging materials including scales, bags, grinders, sealers, smoking bongs, and pipes.
A second resident of the apartment was later observed driving around the apartment complex. Cheryl Davitt age 28 was taken into custody as she parked her vehicle.
The third resident John Rose age 24 refused detectives requests to come back to the apartment. An Arrest warrant for Rose is forthcoming.
Elizabeth Clark was subsequently arrested for the following charges and held on a $100,000.00 bond:
Possession of over 4 ounces of Marijuana
Possession With Intent to Sell over one Kilo of Marijuana
Cultivation of Marijuana
Operating a Drug Factory
Possession of Drug Paraphernalia
Tampering with Evidence
Reckless Endangerment
Carrying a Pistol without a Permit
Illegal Possession of an Assault Weapon
Cheryl Davitt was subsequently arrested for the following charges and held on a $50,000.00 bond:
Possession of over 4 ounces of Marijuana
Possession With Intent to Sell over one Kilo of Marijuana
Cultivation of Marijuana
Operating a Drug Factory
Possession of Drug Paraphernalia
An arrest warrant is being submitted to Middlesex Superior Court for John Rose.
